Drug cases can often result in sentences that involve jail time. This is especially true in those cases where a person has a prior criminal record for having committed drug offenses. These heavy sentences are especially likely in those courts that are considered more conservative, such as those in Cobb County. If you are charged in one of these counties, and the drug quantity is large, or if this is part of a bigger case, then the chances are great that the prosecutors want you to serve jail time. As a result, we take a very aggressive approach to defending drug cases. Even in those cases where jail time may seem imminent, we enjoy a high success rate helping clients charged with serious drug crimes by having their cases dismissed, reduced, or won.
2. What can I expect to be done in my case? (back to top)
Once you have retained our firm to help you with your case, you may expect that we will need to meet with you and/or your family to discuss all of the facts and circumstances surrounding the case. We will then notify the courts of our representation and begin the process of communicating with those who will be involved in the decision-making process. This includes the judge, the prosecutor, and those police officers who may have a role to play in disposing your case. We will also begin to file all relevant motions in order to protect your rights and to ensure you that when your case comes to court you will see the full application of the law and the state and federal constitutions in this case. Also, if law enforcement personnel have seized you or your family’s property, we can assist you in preventing your property from being forfeited to the state. (We refer to those processes by which the state can take a person’s property charged with a drug offense. This may be a house, a car, the cash in your pocket, or anything of value that the state hopes to gain from prosecution of this drug case).
3. How will my case proceed through the courts? (back to top)
Drug cases typically take a long period of time to get to court, because the drugs in these cases usually have to be sent to the state crime lab for analysis. This process alone might take generally between 3 to 6 months for test results. We use this time to speak to the officers, to our client, and their family in order to prepare the case for disposition. Some drug cases may involve multiple defendants where each defendant may be required to have his own attorney.
Drug cases are typically assigned to a special prosecutor who handles drug cases. You may even be required to attend a drug court such as they have in Cobb County. It may take several court appearances before your case can be concluded successfully. We will, however, keep you informed every step of the way so that we may help you understand this difficult process.
