Expungement of Criminal Records

     When a person requests that his criminal record be expunged, he is formally asking that a particular offense for which he or she was arrested be taken off their criminal record.  Expungements are granted in very limited situations; these include: 

  1. If there is evidence that the person’s criminal record is inaccurate or incomplete.

    OR

  2. If the person was released from jail without the offense ever being referred to a prosecutor.

    OR

  3. If the charges were dismissed without the person ever being prosecuted.
